But by using my step by step guide it can be done. You have to pray, be patient and be persistent in order to win your case. I filed a discrimination lawsuit after I felt my civil rights had been violated at my place of employment. The first step I took was to file a claim with the EEOC. The EEOC is a division of our Federal Government. This agency investigates charges against the employer, labor union or employment agency that may have violated your civil rights. The EEOC offers mediation, arbitration, legal advice and legal representation.
After you contact the EEOC write a letter to the U. S. Commission on Civil Rights. This organization was established to protect the voting rights and the right to equal opportunities in education, employment, housing and other areas for minorities.
The EEOC will evaluate your charge and assign you an investigator. The investigator will request information concerning your allegations and compile a file with details surrounding the alleged discriminatory action. After the investigation the EEOC will issue a right to sue letter to you or take your case to court for you. The right to sue letter will enable you to retain a lawyer and pursue your case further.
After you receive your right to sue letter it is time to file your case in court. To file your case in court write or visit the District Court in your area. The District Court will provide you with a copy of the Guide to Practice. You may use this guide to prosecute your case yourself or contact an Attorney to handle your case for you. You may request a list of Attorneys from the NELA. NELA is short for National Employment Lawyers Association. These professionals provide services for employment discrimination, wrongful termination, employee benefits and other employment related matters.
After you file your case in court you may request your EEOC file. Having a copy of your file will provide your lawyer with information and also keep him/her from investigating facts that have already been examined.
